The National Institute for the Defense of Competition and Protection of Intellectual Property (INDECOPI), Peru’s public agency responsible for promoting fair competition and safeguarding intellectual property rights, has released a new regulation aimed at ensuring that the use of AI-based technologies within the institution is conducted in a transparent, secure, inclusive manner and with respect for fundamental rights.
In a global context where artificial intelligence is advancing rapidly and redefining key sectors such as health, education, justice, and intellectual property, INDECOPI has taken a pioneering step by approving its Guidelines for the Ethical Use of AI.
The measure, formalized through Resolution No. 000062-2025-GEG/INDECOPI, establishes a regulatory framework to ensure that the use of AI technologies within the institution is transparent, safe, inclusive, and respectful of fundamental rights.
A Preventive and Forward-Looking Approach
The guidelines respond to a growing concern: how to ensure that automation and the use of algorithms do not violate rights or reproduce biases. To address this, INDECOPI has defined guiding principles such as algorithmic transparency, personal data protection, continuous human oversight, non-discrimination, and institutional responsibility.
The guidelines also explicitly prohibit practices such as unauthorized surveillance, information manipulation, and automated decision-making without human supervision.
Active Oversight and Internal Training
The Office of Information Technologies (OTI) will be responsible for implementing and monitoring compliance with these guidelines. Its duties include:
- Creating an inventory of AI systems used within the institution
- Prioritizing projects with an ethical focus
- Conducting technical audits and impact assessments
In addition, internal training programs will be promoted to help INDECOPI staff understand the scope, risks, and best practices in the use of AI.
With this initiative, INDECOPI positions itself as one of the pioneering public institutions in Latin America to adopt a comprehensive and preventive approach to the use of artificial intelligence. The measure not only regulates the internal use of these technologies but also sends a clear message to the innovation ecosystem: technological development must be guided by ethical values and principles of social justice.
