1977 Budapest Treaty on the International Recognition of the Deposit of Microorganisms for Patent Procedure”. By Law No. 7041/2022, the aforementioned treaty will enter into force in the country as of August 5 of this year.
This system grants international recognition to a single deposit of microorganisms before an international depository authority, regardless of where said authority is located, provided that WIPO approves it. This eliminates the requirement hitherto required to register the certifying institute of the microorganism with Dinapi previously; It is now sufficient to present a certificate issued by any WIPO-approved institute, along with its sworn translation, when submitting a new application.
