The Brazilian Patent and Trademark Office (BRPTO) has announced that, beginning on August 7, 2025, a new service called the Fast-Track Trademark Examination will be available. This procedure will allow for the accelerated review of certain trademark applications and petitions. The initiative is part of the BRPTO’s 2025 Action Plan, which aims to foster innovation, drive economic growth, and modernize the Brazilian industrial property system.
Requests can be submitted by the trademark holder or a legally authorized representative. Applicants must complete a specific form, provide supporting documentation, and, in some cases, pay a fee.
Who can apply for the Fast-Track Trademark Examination:
Legal Priority (free of charge):
– Individuals aged 60 or older
– Persons with disabilities or severe illnesses
– Companies registered under the Inova Simples framework
Strategic Priority (fee of BRL 890.00):
– Applicants who have filed oppositions based on prior rights
– Cases involving public funding or judicial proceedings
– Products/services related to patents under fast-track examination
– Scientific, Technological and Innovation Institutions (STIs) and beneficiaries under BRPTO Technical Cooperation Agreements (TCAs)
– Cases of public interest or national emergency
